By accessing or using LeakProof AI, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Service. Please read them carefully before proceeding.

1. About the Service

LeakProof AI ("we," "us," "our") provides an AI-powered missed call recovery and lead follow-up platform for home service contractors. The Service is available at contractorrecovery.com and includes automated SMS outreach, lead qualification, appointment booking, CRM integration, and related features ("the Service").

2. Eligibility

You must be at least 18 years old and operating as a legal business entity or sole proprietor to use LeakProof AI. By agreeing to these Terms, you represent and warrant that you meet these requirements.

3. Account Registration

You agree to:

Provide accurate, complete, and current registration information

Maintain the confidentiality and security of your account login credentials

Accept full responsibility for all activity that occurs under your account

Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts with inaccurate information or that violate these Terms.

4. SMS & Text Messaging Terms

Program Description: LeakProof AI sends automated SMS messages on behalf of registered contractors to their leads and customers. Messages include missed call text-backs, lead qualification messages, appointment confirmations, and follow-up sequences.

Consent: By providing your phone number and checking the SMS consent box on our opt-in form, you consent to receive automated text messages from LeakProof AI. You acknowledge that:

Message frequency may vary based on account activity and lead volume

Message and data rates may apply depending on your carrier plan

SMS consent is not required as a condition of purchasing or using the Service

SMS consent is not transferable or assignable to any third party

Consent to marketing messages and non-marketing messages are separate and distinct

OPT-OUT INSTRUCTIONS

To stop receiving SMS messages from LeakProof AI at any time, reply STOP to any message. You will receive a one-time confirmation and no further messages will be sent. To re-enable messages, contact [email protected].

For assistance, reply HELP to any SMS message or contact us at [email protected]. Support hours: Monday–Friday, 9am–6pm EST.

Carrier Disclaimer: Carriers are not liable for delayed or undelivered messages. Message delivery is subject to your carrier's network availability.

5. Free Trial

LeakProof AI offers a 14-day free trial. No credit card is required to begin the trial. At the end of the 14-day period, you must subscribe to a paid plan to continue using the Service. We reserve the right to modify or discontinue free trial offers at any time without notice.

6. Subscriptions & Billing

Paid subscriptions are billed monthly in advance on your billing date

All fees are non-refundable unless required by applicable law

Pricing is subject to change with a minimum of 30 days' written notice

Failure to pay may result in immediate suspension of your account

You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period and no further charges will be made

7. Acceptable Use Policy

You agree NOT to use LeakProof AI to:

Send spam, unsolicited bulk messages, or harassing communications

Contact any individual who has opted out or requested to stop receiving messages

Violate any applicable law or regulation, including TCPA, CAN-SPAM Act, or GDPR

Send prohibited content including but not limited to: cannabis-related content, hate speech, violence, adult content, phishing, or fraudulent messages

Reverse engineer, decompile, or attempt to extract our source code

Resell, sublicense, or white-label the Service without prior written permission

Use the Service for any illegal, deceptive, or fraudulent purpose

Impersonate any person or entity or misrepresent your affiliation

8. TCPA & SMS Compliance Responsibility

You are solely and exclusively responsible for compliance with all applicable federal, state, and local laws governing SMS and telephone communications, including the Telephone Consumer Protection Act (TCPA) and the CAN-SPAM Act. Your responsibilities include:

Obtaining proper prior written consent from all message recipients before sending automated messages

Honoring all opt-out requests promptly and permanently

Maintaining accurate records of consent for all contacts

Ensuring compliance with A2P 10DLC registration requirements

Not contacting numbers on the National Do Not Call Registry without express written consent

LeakProof AI provides the technology platform only. We are not responsible or liable for your failure to comply with messaging laws, regulations, or carrier requirements.

9. Intellectual Property

All software, designs, trademarks, logos, and content associated with LeakProof AI are our exclusive property and protected by applicable intellectual property laws. You retain full ownership of your business data. You grant us a limited, non-exclusive license to use your data solely for the purpose of providing the Service to you.

10. Confidentiality

Both parties agree to keep confidential any non-public, proprietary information disclosed in connection with the Service. This obligation does not apply to information that is publicly available or required to be disclosed by law or court order.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY RESULTS OBTAINED THROUGH USE OF THE SERVICE WILL MEET YOUR EXPECTATIONS.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LEAKPROOF AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR BUSINESS INTERRUPTION ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO LEAKPROOF AI IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

13. Indenification

You agree to defend, indemnify, and hold harmless LeakProof AI and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your violation of any third-party rights.

14. Termination

We reserve the right to suspend or terminate your access to the Service immediately and without notice if you violate these Terms or engage in any conduct that we determine, in our sole discretion, is harmful to LeakProof AI, other users, or third parties. Upon termination, your right to access and use the Service ceases immediately. All provisions that by their nature should survive termination shall survive.

15. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction in such courts.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or by posting a notice on our platform. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
